Arbitrator hands Mapquedt.com domain name to AOL

  AOL ,the American global Internet services and media company,has recently submitted a complaint to the National Arbitration Forum requesting that the mapquedt.com domain name to be transferred from the respondent to the complainant.
The company owns several trademark registrations with the United States Patent and Trademark Office fo the "Mapquest.com" mark.The company also owns several trademark registrations with the United States Patent and Trademark Office for the "Mapquest" mark .
Therefore,they contended in the complaint that the domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the domain name in bad faith .
"Respondent is attempting to sell the domain name to the highest bidder through the third-party website . Complainant argues that Respondent’s willingness to sell the disputed domain name is evidence that Respondent registered and is using the disputed domain name in bad faith. "
"Respondent’s use of the disputed domain name to divert Internet users to competing mapping and travel websites, presumably for commercial gain, disrupts Complainant’s business and is evidence of bad faith registration and use."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel decided the disputed domain name to be transferred from the respondent to the complainant.
