An arbitrator with the National Arbitration Forum has awarded the domain name TDCanadaTrust.XXX to the Toronto-Dominion Bank.The company filed a complaint to the National Arbitration Forum on May 8,2012,asserting legal rights over the disputed domain name. The complainant owns many trademark registrations for the following marks : TD Bank,Canada Trust,TD and Design and TD.Therefore,it is more than obvious that the disputed domain name is confusingly similar to its trademark.

           The Toronto Dominion Bank has also contended in the complaint and managed to demonstrate that the respondent registered and used the disputed domain name in bad faith :

     "Respondent registered the disputed domain name in bad faith because it had constructive and actual knowledge of Complainant’s famous marks.Respondent has used the disputed domain name in bad faith by resolving the domain name to a parked website featuring third-party hyperlinks."

        The Panel ordered the disputed domain name to be transferred from the respondent to the complainant.
